A person commits an offense if the person is the owner of property and the owner knowingly fails to paint over or remove the graffiti from the property within fifteen (15) days after the notice of the presence of graffiti has been received in accordance with this section.

The notice may not be given to the property owner unless the City has first offered to remove the graffiti from the owner's property free of charge and the owner has refused the City's offer.

The requirement that an owner remove graffiti from the owner's property under this subsection shall not apply if the graffiti is located on transportation infrastructure and the removal would create a hazard for the person performing the removal.
